What are cookies

Cookies (or markers) are small text files sent by the web server visited by the user to the user’s device (usually to the browser) when the user accesses a specific website, with the purpose of storing and transporting information. They are stored in a way that allows the device to be recognized during subsequent visits. On each subsequent visit, the cookies are sent back from the user’s device to the website.

Each cookie generally contains the name of the server from which it was sent, its expiration, and a value, usually a unique randomly generated number by the computer.

First-party and third-party cookies

Technical cookies are installed solely to “carry out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service” (see Article 122, paragraph 1, Privacy Code).

They are usually used to enable efficient navigation between pages, store user preferences, save information about specific user settings, perform user authentication, etc.

Technical cookies can be divided into navigation cookies, used to record data necessary for the normal navigation and use of the website on the user’s computer (for example, remembering the preferred page size in a list), and functional cookies, which allow the website to remember user choices to optimize its functionalities (for instance, functional cookies enable the site to remember specific user settings, such as the selected country and, if set, the persistent login state). Some of these cookies (called essential or strictly necessary) enable functions without which certain operations would not be possible.

Pursuant to the aforementioned Article 122, paragraph 1, of the Privacy Code, the use of technical cookies does not require user consent but only the obligation to inform users.

Pursuant to the Provision, analytics cookies are assimilated to technical cookies—and therefore, their installation does not require user consent—if:

i) created and used directly by the first-party website operator (therefore, without the involvement of third parties) for optimization purposes, to collect aggregated information on the number of users and how they visit the website, as well as

ii) created and made available by third parties if:

a. used by the first-party website solely for statistical purposes, provided appropriate minimization measures are adopted to reduce their identifying power (for example, by masking appropriate portions of the IP address) and used exclusively to generate aggregate statistics, typically related to a single website or mobile application, so as not to allow the tracking of the navigation of the individual across different applications or websites;

Profiling cookies are used to track the user’s navigation, analyze their behavior for marketing purposes, and create profiles based on their tastes, habits, choices, etc., in order to send targeted advertising messages related to the user’s interests and in line with the preferences they have expressed during online browsing. Such cookies, pursuant to Article 122 of the Privacy Code, can be installed on the user’s device only if they have given their consent after being informed using the simplified methods indicated by the Authority in the Provision (publication on the site of a “short” notice contained in a banner that immediately appears on the home page (or another page through which the user can access the site), which refers to an “extended” notice accessible through a clickable link by the user).

Persistent and session cookies

Based on their duration, cookies are classified as persistent, which remain stored on the user’s device until their expiration unless removed by the user, and session cookies, which are not stored persistently on the user’s device and disappear when the browser is closed.

These cookies, appropriately anonymized (by masking significant portions of the IP address), enable the collection of aggregated information on the number of users and how they visit the website without identifying individual users. Therefore, prior user consent is not required in accordance with the Provision.

Pixel

The Website uses tracking technologies known as “pixels” to allow the user to interact with the Website based on their unique identifier from another site (e.g., a social network) and to receive any promotional communications on that site, on our behalf, based on their visit and demonstrated interest.

3. Provision of data

The data related to the technical cookies used on this site are necessary for the provision of the related service; therefore, failure to provide such data will result in the inability to use the requested service.

4. Recipients

The processing related to the web services of this Website is carried out by personnel expressly authorized for processing who have received adequate operational instructions.

The data may also be processed, on behalf of the Data Controller, by third parties designated as Data Processors pursuant to Article 28 of the GDPR, such as individuals and/or legal entities performing activities essential to the purposes indicated above, for example, the company responsible for the management and maintenance of the Website.

The data may be disclosed to independent data controllers, such as authorities and supervisory and control bodies authorized to request/receive the data, as well as to third-party providers (or vendors) listed in the tables above containing the list of cookies, which also include links to the relevant privacy policies.

Where data is transferred to countries outside the European Union (EU) or the European Economic Area (EEA) that have not been deemed adequate by the European Commission, “transfer tools” under Article 45 of the GDPR will be used, assessing the potential implementation of “supplementary measures” to ensure a level of protection substantially equivalent to that required by European Union law. 5. The rights of data subjects

With regard to the processing of personal data carried out by the Data Controller, the data subject, in addition to what is indicated in the previous paragraph, may exercise the rights set out in Articles 15 to 22 of the GDPR, where applicable. In particular, the data subject may request access to their data and the information referred to in Article 15 (purposes of processing, categories of personal data, etc.), the deletion of data in the cases provided for by Article 17, the rectification of inaccurate data, the integration of incomplete data, the restriction of processing in the cases provided for by Article 18, as well as data portability (i.e., to receive the data in a structured, commonly used, and machine-readable format, and, if technically feasible, to transmit them to another controller without obstacles) where the processing is based on consent or a contract and is carried out using automated tools.

The data subject has the right to lodge a complaint with the supervisory authority of the Member State where they habitually reside or work, or of the State where the alleged violation occurred.
